Soroya Hearing Aids recommends a trial period of 21 days. This trial period is recommended because medical studies show that your brain requires about three weeks to adjust your hearing sense to new hearing aids. You can return your hearing aids at any time within 30 days from the date you receive the product:


Purchase Terms:

By selecting an available option, completing the order form and paying the associated fee, You are making a purchase (“Purchase”). When a Customer makes a  purchase, the Customer agrees to abide by the terms of this Agreement and represent and warrant that You as the Customer (i) are at least 18 years of age, (ii) are legally able to enter into this Agreement with Soroya Hearing Aids, and (iii) understand that the hearing aids provided under this Agreement are not intended for use by anyone under age 18. If You as the Customer do not agree with the foregoing, You may not Purchase and must return hearing aid(s) (“Device”) and all associated accessory parts and materials (collectively “Equipment”) to Us. This Agreement is deemed to be received by You as the Customer and is effective on the date on which You Purchase (“Effective Date”) and continues until terminated by either party.


Delivery: 

Your order will ship via USPS, FedEx, UPS, DHL, or other carriers. In most cases, your order will be delivered within seven (7) to fourteen (14) days. We are not responsible for delays in making delivery or failure to make delivery due to causes beyond our control including, but not limited to, acts of regulations of any governmental authority, fire, work stoppages or slowdowns, accident, flood, war, national emergency, acts of God, public disorder, transportation shortages or delays, and shortages of fuel or materials.Affected by Covid-19, there will be some delay on the delivery.


30 Day Satisfaction Guaranteed Return Policy

When you purchase a product from Soroya Hearing Aids, the first 30 days are considered as a bona fide hearing aid evaluation for a prospective user, if you are unsatisfied with your purchase from Soroya Hearing Aids for any reason, you have 30 days from the date you received the Product to request a full refund. You should return any Product (as defined below) purchased on Soroya Hearing Aids in accordance with the terms below, excluding the purchase or renewal of any Soroya Hearing Aids paid services, which are subject to our Terms of Use & Conditions.


Terms of Use & Conditions

To qualify for a 30 Day Satisfaction Guarantee Refund, all the following conditions must be met:

1. The prospective user has followed all the steps described on the Bona Fide Evaluation Period Process below. 

2. A Return Merchandise Authorization (RMA) must be requested within 30 days after the date you received the Product. 

3. You must return the Product to Soroya Hearing Aids to receive a refund. Returned Product(s) must be in good physical condition (not physically broken or damaged) and perfectly clean. All accessories originally included with your purchase must be included with your return, original packaging, user manuals, Inserts and other printed documents.

4. The Return Merchandise Authorization (RMA) must be included along with your returned product.

5. If Customers choose to upgrade to a higher price model, the credit from the original order will be applied to the upgraded exchange order. If you choose to try the upgrade exchange order and go beyond the 30 day satisfaction period of the first original paid order, your first original paid order that was used as a credit towards the upgrade exchange order will not be refunded.

6. From the day you get your RMA number, you have 30 calendar days to use your RMA number and ship the product back to our warehouse. The product must have arrived at our warehouse within 30 days, otherwise your return will be discarded and you will not be eligible a refund.

Additional terms and conditions:

a.- Shipping and handling charges, gift wrap fees, and taxes paid (such as state, customs, or VAT) are not refundable.

b.- We will provide you a prepaid Return Label to ship your product for $9.95 through email or $13.95 for a paper mailed label. If you decide not to use this label and use your own return methods, You are responsible for and must pay all shipping charges and you assume the risk of loss or damage to the returned Product(s) while in transit back to Soroya Hearing Aids.

C.- If you return Product to Soroya Hearing Aids (a) without a Return Merchandise Authorization (RMA) from Soroya Hearing Aids or/and (b) without all parts and accessories originally included with your purchase, Soroya Hearing Aids retains the right to either refuse acceptance of such return or charge you a restocking fee of 20% of the original price of the Product(s) or the retail value of the missing parts and accessories, whichever is higher.


Refunds: 

There is typically a delay between the time your returned package is delivered by the carrier/scanned into our system and the time the contents are verified by our warehouse and your refund is processed. If all return instructions are followed (see “To qualify for a 30 Day Satisfaction Guarantee Refund”) and a refund is due, please expect up to four (4) weeks after your package is delivered to our warehouse to allow us time to receive, inspect, and verify your return and complete your refund request. In most cases, however, your refund will be processed in less time.

IN THE EVENT YOU HAVE NOT RECEIVED YOUR REFUND WITHIN THE TIME FRAME AS INDICATED ABOVE, PLEASE CONTACT US AT tommy@soroya-hearing.com AND WE WILL QUICKLY RESOLVE ANY ISSUES.

Bona Fide Evaluation Period Process

1.- After the Prospective User purchased a Product, the User must conserve the Order Number as it will be used as an identification number which will link the product to the Prospective User.

2.- Once the Prospective User receives the product, they should call a Soroya Hearing Aid Specialist at  (516)-340-3333

3.-The Prospective User and the  Specialist will review the content of the box, if some part or if some accessory is missing the Specialist will quickly solve the problem for you.

The Specialist will guide the Prospective User on how to assemble and disassemble the Hearing Aid and will also explain how to operate and maintain the device, resolving any question the Prospective User could have. 

The Specialist will explain how the brain will have to adjust its hearing sense while using the new hearing aids, the brain will need 21 days to adapt the hearing sense to this new condition, this is called the “Hearing Journey”. So these next few weeks are essential for the Prospective User to determine if the hearing aid is the adequate product for its needs.

By the 2nd week, the Prospective User is adapting to the hearing aids.

At this point, Brain and hearing senses are fully adapted to the Hearing aid. The Hearing Journey has ended and the customer should call a Soroya Specialist will now guide the Prospective User to the final part of the evaluation asking key questions to assist the Prospective User to determine if the Hearing Aid is appropriated or if another model is more suitable for its needs. 

The Specialist will also explain to you about the Tune-Up Service and other Service Plans available.

Customer service advice:

-Hearing Aids are not designed to restore normal hearing and will not prevent or improve a hearing impairment resulting from organic conditions. 

-In most cases, the infrequent use of a hearing aid does not permit a user to attain full benefit from it. 

-The use of a hearing aid is only part of hearing habilitation and may need to be supplemented by auditory training and instruction in lip reading. 

-Do not attempt to use a hearing aid in a method not instructed within the accompanying manual. 

-Our hearing aids are not suitable for use by anyone under age 18.

-Keep hearing aids out of reach of infants, children, and pets as it may cause a choking or ingestion hazard.


Service, Repair & Replace After the Evaluation Period:

After your Thirty (30) day evaluation period has expired, the cost of any hearing aids service and/or battery replacement and/or any other replacement parts (including accessories) or repair service becomes a Customer responsibility unless the Product is still under the One Year Limited Manufacturing Warranty and we deem it to be a manufacturer defect in our sole discretion or covered under a product “Elite Protection Plan” or any other available “Service Plans” separately provided for sale by Soroya Hearing Aids Customer Service.


Cancellations

You can cancel your order before the product is shipped. Your entire order amount will be refunded. You may call us (516) 340-3333. Please cancel within 15 hours of placing the order and before dispatch as we normally dispatch within 24 hours of placing the order.

Once you request the cancellation of item(s) in your order, it will take us a maximum of 1-2 business days to cancel the order and initiate a refund. You will be notified the same way you contacted us.

If the Order Status shows the item(s) in your order as 'Shipped', or if your order has a tracking number assigned, it won't be possible to intercept shipment and you will be requested to either Refuse the package or Return to Sender (RTS). This action will incur a cancellation fee of $49 USD (flat rate) and will be deducted from your refund amount. Your refund will be processed soon after we receive the cancelled items back from the courier.

Limited Manufacturing Warranty

1 year starting from the date of purchase

Soroya Hearing Aids warrants to the original purchaser that your Soroya Hearing Aids-branded device (the "Product") shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. If such a defect arises and a return authorization request is received by Soroya Hearing Aids within the applicable Warranty Period, Soroya Hearing Aids will, at its option and to the extent permitted by law, either 

(A) repair the Product at no charge, using new or reconditioned replacement parts or 

(B) replace the Product with a New or reconditioned product. 

In the event of such a defect, to the extent permitted by law, these are your sole and exclusive remedies. Shipping and handling charges may apply except where prohibited by applicable law. This Limited Manufacturing Warranty is valid only in the jurisdictions where the Products are sold by Soroya Hearing Aids itself or through its authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions. Any replacement Product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer, or for any additional period of time that may be required by applicable law.


Advice:

Do not wear hearing aids while sleeping, participating in vigorous exercise, showering/bathing, washing your hair, swimming or engaging in any other activity during which hearing aids may get wet.  It is recommended that you do not wear hearing aids during any activity that calls for the use of hearing protection. Due to the radio frequency interference caused by digital cell phones, you may not be able to use any hearing aid with a mobile phone. If, while wearing Device, you experience buzzing or other noises when using your cell phone, we recommend that you refrain from using hearing aids with a mobile phone or other devices that emit radio waves. Avoid using hair care products while wearing hearing aids.  Keep hearing aids away from moisture, humidity, dust, direct sunlight and extreme heat. When not in use keep them in their case.

Terms of Service

This Limited Manufacturing Warranty applies only to the original purchaser of the Product that was purchased from an authorized reseller or sales channel and manufactured by or for Soroya Hearing Aids that can be identified by an authorized “Soroya Hearing Aids” trademark, trade name, or logo affixed to it. 


Without limiting the foregoing, the Limited Manufacturing Warranty does not apply to any 

(a) Soroya Hearing Aids products and services other than the Products

(b) non-Soroya Hearing Aids products, even if included or sold with a Product, including, without limitation, any counterfeit products, 

(c) products that are, or Soroya Hearing Aids reasonably believes to be stolen, 

(d) consumables (such as batteries), or 

(e) accessories, even if packaged or sold with the Product or embedded in the Product. 

This Limited Manufacturing Warranty does not apply to products with the “Made for Soroya Hearing Aids” or “Works with Soroya Hearing Aids” logos or “Designed for Soroya Hearing Aids accessories”.

This Limited Manufacturing Warranty does not apply to a Product or part of a Product that has been serviced, altered, refurbished, or modified by anyone who is not authorized by Soroya Hearing Aids, nor does it apply to any cosmetic damage such as scratches and dents, nor does it apply if  the warranty period has expired, nor if the inner warranty label is broken or removed, or the serial number label is missing or unrecognizable.

In addition, this Limited Manufacturing Warranty does not apply to damage or defects caused by
(a) use with non-Soroya Hearing Aids products; 

(b) accident, abuse, misuse, mishandling, flood, fire, earthquake or other external causes; 

(c) normal wear and tear or aging of the Product such as discoloration or stretching; or 

(d) operating the Product:

(i) outside the permitted or intended uses described by Soroya Hearing Aids, 

(ii) not in accordance with instructions provided by Soroya Hearing Aids, or 

(iii) with improper voltage or power supply.


Disclaimer of Warranty

Warranties Exclusive

If the Soroya Hearing Aids product does not operate as warranted above, the customer's sole remedy shall be, at Soroya Hearing Aids's option, repair or replacement. The foregoing warranties and remedies are exclusive and are in lieu of all other warranties, expressed or implied, either in fact or by operation of law, statutory or otherwise, including warranties of merchantability and fitness for a particular purpose. Soroya Hearing Aids neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale, maintenance or use of Soroya Hearing Aids's products.

Soroya Hearing Aids shall not be liable under this warranty if its testing and examination discloses that the alleged defect in the product does not exist or was caused by customer's or any third person's misuse, neglect or testing, unauthorized attempts to repair or modify, or any other cause beyond the range of the intended use, or by accident, fire, lightning, or other hazard.


Limitations of Liability

Under no circumstances will Soroya Hearing Aids, its service provider or either's affiliates, employees, officers, directors or agents be liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to), claims for personal damage, goodwill, inconvenience, delay, profits, use of money or use of the Soroya Hearing Aids products or interruption in use.

Soroya Hearing Aids and the service providers entire liability and customer's sole and exclusive remedy for claims related to or arising out of these terms and conditions for any cause and despite the form of action, whether in contract or in tort, statutory or otherwise, including negligence and strict liability, will not exceed the amount of the purchase price paid. This limitation of liability will be effective even if customer has advised Soroya hearing aids or its service provider of the possibility of any such damages.

These terms and conditions gives the customer specific legal rights. Customer may also have other rights that may vary from state to state or from country to country. Customer is advised to consult applicable state or country laws for a full determination of customer's rights. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of these terms and conditions may not apply to customer.


Implied warranties

Except to the extent prohibited by applicable law, all implied warranties (including, without limitation, warranties of merchantability and fitness for a particular purpose) shall be limited in duration to the duration of this limited warranty. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.


Conciliation, Mediation and Arbitration, Alternative Dispute Resolution:

Soroya Hearing Aids believes in using of the Alternative Dispute Resolution System to help avoid the expenses and wasted time associated the normal Litigation System. We value our relationship with every customer, for this reason, in the event of any controversy, claim or dispute between Soroya Hearing Aids and any Customer arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the termination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Arizona, in accordance with the laws of the state of Arizona for agreements to be made and to be performed in Arizona. Except as otherwise provided in this agreement, Soroya Hearing Aids and you, as the Customer, hereby consent to the resolution by binding arbitration of all claims or controversies for which a federal or state court would be authorized to grant relief. The parties agree, the arbitration shall be administered by jams pursuant to its comprehensive arbitration rules and procedures and an arbitrator shall be selected by the jams. The arbitrator shall be neutral and independent and shall comply with the jams code of ethics. The arbitrator shall issue a written award, setting forth the award and basis therefore. The award shall be final and binding upon the parties. The arbitrator shall have the power to award any type of relief that would be available in a court of competent jurisdiction. In addition, the arbitrator shall have the authority to order any party found to have presented any claim or defense without substantial justification to pay the other party’s attorney’s fees and costs. The award rendered by the arbitrator shall be final and shall not be subject to vacation or modification. Judgment on the award made by the arbitrator may be entered in any court having jurisdiction over the parties. If either party fails to comply with the arbitrator’s award, the injured party may petition the circuit court for enforcement. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding. Representation: each party may be, but need not be, represented by an attorney at any arbitration covered by this agreement. Allocation of fees and costs: the arbitrator may, in the award, allocate all or part of the costs of the arbitration, including the fees of the arbitrator and the reasonable attorneys’ fees of the prevailing party. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award. Discovery: the parties shall be entitled to engage in reasonable discovery in the form of requests for documents, interrogatories, requests for admission, physical and/or mental examinations and depositions, in order to obtain information necessary to prosecute or defend the claims brought. Any disputes between the parties regarding the nature or scope of discovery shall be resolved by the arbitrator(s) in his or her discretion. Exclusive remedy: for claims covered by this agreement, arbitration is the parties exclusive legal remedy. The arbitrator has exclusive authority to resolve any dispute relating to the applicability or enforceability of this agreement.


Governing Law

This Limited Warranty shall be governed by the laws of the State of Arizona, USA, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.


IMPORTANT NOTICE:

Soroya Hearing Aids are Class 1 Hearing Aid devices under FDA Regulations. For mild to moderate hearing loss. Not suitable for anyone under 18 years of age. As with all medical issues, please consult a physician prior to use or if you have any questions. Individual results will vary, read all instructions/disclosures before use. IMPORTANT NOTICE FOR PROSPECTIVE HEARING AID USERS

Good health practice requires that a person with a hearing loss have a medical evaluation by a licensed physician (preferably a physician who specializes in diseases of the ear) before purchasing a hearing aid. Licensed physicians who specialize in diseases of the ear are often referred to as otolaryngologists, otologists or otorhinolaryngologists. The purpose of the medical evaluation is to assure that all medically treatable conditions that may affect hearing are identified and treated before the hearing aid is purchased


IMPORTANT MEDICAL INFORMATION: 

Soroya Hearing Aids advise all prospective hearing aid user to consult promptly with a licensed physician (preferably an ear specialist) before buying a hearing aid if Soroya Hearing Aids determines through inquiry, actual observation, or review of any other available information concerning the prospective user, that the prospective user has any of the following conditions: 

(i) Visible congenital or traumatic deformity of the ear. (ii) History of active drainage from the ear within the previous 90 days. (iii) History of sudden or rapidly progressive hearing loss within the previous 90 days. (iv) Acute or chronic dizziness. (v) Unilateral hearing loss of sudden or recent onset within the previous 90 days. (vi) Audiometric air-bone gap equal to or greater than 15 decibels at 500 hertz (Hz), 1,000 Hz, and 2,000 Hz. (vii) Visible evidence of significant cerumen accumulation or a foreign body in the ear canal. (viii) Pain or discomfort in the ear.

Soroya Hearing Aid Elite Protection Plan - 

This service will protect your Soroya Hearing Aid Product from accidental damages for 1 year (conditions and deductibles may apply, prices vary according to model) auto-renews every year.

    • Can upgrade to a higher priced model with 20% OFF of the total price 
    • This plan can only be purchased at the time of purchasing a new hearing aid (Elite Protection Plan is only good for the hearing aid that was purchased with the Elite Protection Plan. 
    • 30% deductible if you lose it (30% of the total price of the replacement, same model*
    • Coverage for all types of accidental damage (except loss)
    • 100% parts and labor (for damaged parts and not for cleaning  service)
    • Covers any defects or malfunctions (defects/malfunctions from manufacture) 
  • Earwax buildup is not covered here and will incur a $49/single or $79/pair per fee
    • If we can’t fix it, we will exchange your hearing aids for a similar priced pair (up to once a year)
    • Free troubleshooting help over the phone as many times as you like during our business hours

    The Elite Plan can only be purchased when Customers buy new hearing aids and at the moment they pay for the new product. The Elite Plan will not be available for used devices.


    *If  Customer chooses to upgrade to a higher price model, this Elite Protection Plan will terminate and if customers still want to be protected with this plan it will be necessary to subscribe to a new service plan.
    **If Customer acquires a new product due to loss, this Elite Protection Plan will terminate and if customers still want to be protected with this plan it will be necessary to subscribe to a new service plan.
    ***If the customer receives a replacement due to previous device couldn't be fixed, this Elite Protection Plan will terminate and if customers still want to be protected with this plan it will be necessary to subscribe to a new service plan.

    To Get Service:

    If your hearing aid needs a Tune-Up or stops working and you have the Elite Protection Plan, contact us for an Admittance Number (AN) and instructions.     SERVICE CONTRACT PERIOD, COVERAGE AND TERMS OF SERVICE

    These Services are offered by Soroya Hearing Aids, accepting any of these Services by completing the order form and paying the associated fee, You are accepting an agreement with Soroya Hearing Aids. This agreement describes the terms and conditions of product service contract provided by Soroya Hearing Aids and the Service Contract Holder, hereinafter referred to as “Customer”,“You”, or “Your”. The Customer agrees to abide by the terms of this Agreement and represent and warrant that You as the Customer (i) are at least 18 years of age, (ii) are legally able to enter into this Agreement with Soroya Hearing Aids.


    To Get Service:

    If your hearing stops working and you have the Elite Protection Plan, contact us for an Admittance Number (AN) and instructions. If it is necessary to send the hearing aid to us, you are required to pay for postage and processing to Soroya Hearing Aid. For fastest service call:(516) 340-3333


    2.- Soroya Hearing Aid Elite Protection Plan,  it will only include one (1) year (from the date of the original invoice for your hearing aid) coverage repair for all types of accidental damage including any defects or malfunctions and covering a 100% parts and Labor cost, accessories supplied with hearing aids are not included (e.g. Tubings, Domes, Wax guards, Tips, Batteries, etc), malfunctions due to wax or dirt buildup blockage are not included. If we cannot fix it, we will exchange your hearing aids for a similar priced pair up to once a year. If you lose your hearing aid, you will get a new pair paying 30% as deductible (30% of the total price of the replacement, same model). Free troubleshooting help over the phone as many times as you like during our business hours


    By purchasing this Elite Protection Plan service, you will have the option to upgrade your Hearing Aid to a higher priced model, just by paying the difference in price and returning your old hearing aid clean and in full working order. If Customers choose to upgrade to a higher price model, this Elite Protection Plan will finish. If customers want to protect the new acquired hearing aid with this plan it will be necessary to subscribe to a new Elite service plan.


    This Elite Protection Plan plan can only be purchased at the time of purchasing a new hearing aid and will cover and acknowledges only genuine Soroya Hearing Aids devices. Soroya Hearing Aids reserves the right (at its sole discretion) to replace defective parts of the product with either new or refurbished spare parts, or the product with another similar product.


    This Elite Protection Plan Service does not cover earwax or dirt buildup blockages, incur service/cleaning fee. Shipping is not included.

    The Elite Protection Plan plan can only be purchased when Customers buy new hearing aids and at the moment they pay for the new product.The Elite Plan will not be available for used devices.


    If the product proves to be damaged or defective due to improper materials or workmanship, Soroya Hearing Aids (at its sole discretion) will repair or replace the product or its defective parts, without charge for labor or parts, based on the local, normal service lead time, commencing from the day the product was received by Soroya Hearing Aids. Parts will be replaced with those of like kind and quality (We cannot guarantee to match the exact color, material, size, or model), and may be new or remanufactured. In the event that a covered Hearing Instrument(s) is replaced, the coverage for that Hearing Instrument(s) will automatically terminate. Coverage is provided on the replacement up to one (1) year from the original date of purchase of the hearing aid on a 1-Year Elite Protection Plan. All premium under that portion of the Policy is considered earned on the replacement and no refund of the unearned premium is due.


    This Agreement is deemed to be received by You as the Customer and is effective on the date on which You pay the Fee (“Effective Date”) and continues until the one (1) year period has ended or is terminated by either party.


    The following state variations shall control if inconsistent with any other terms and conditions:

     ARIZONA RESIDENTS: If Your written notice of cancellation is received prior to the expiration date, Soroya Hearing Aids shall refund the remaining pro-rata price, regardless of prior services rendered under the Soroya Hearing Aid Elite Protection Plan. The pre-existing condition exclusion does not apply to conditions occurring prior to the sale of the consumer product by Soroya Hearing Aids, its assignees, subcontractors and/or representatives.

    ARKANSAS RESIDENTS: A claim against Soroya Hearing Aids may include a claim for any unearned provider fee.

    CALIFORNIA RESIDENTS: The Cancellation Provision is amended as follows: If the Soroya Hearing Aid Elite Protection Plan is cancelled: (a) within sixty (60) days of the receipt of this Plan, You shall receive a full refund of the price paid for the Soroya Hearing Aid Elite Protection Plan provided no service has been performed, or (b) after sixty (60) days, You will receive a pro rata refund, less the cost of any service received.

    CONNECTICUT RESIDENTS: The expiration date of this Soroya Hearing Aid Elite Protection Plan shall automatically be extended by the duration that the product is in our custody while being repaired. In the event of a dispute with the Administrator, you may contact The State of Connecticut, Insurance Department, PO Box 816, Hartford, CT 06142-0816, Attn: Consumer Affairs. Follow instructions from here: https://portal.ct.gov/CID/Consumer-Affairs/File-a-Complaint-by-Mail ,The written complaint must contain a description of the dispute, the purchase price of the product, the cost of repair of the product and a copy of the Soroya Hearing Aid Elite Protection Plan. You have the right to cancel this Agreement if You return the product or if the product is sold, lost, stolen, or destroyed. If We cancel this Agreement, written notice including effective date and reason for cancellation will be mailed to You electronically or by U.S. Mail at least 30 days prior to termination.

    FLORIDA RESIDENTS: The Soroya Hearing Aid Elite Protection Plan shall be cancelled by Us for fraud or material misrepresentation, including but not limited to commercial or rental use. Unauthorized repair or replacement of covered equipment shall result in the cancellation of the Plan by us. In the event of cancellation by us, written notice of cancellation shall be mailed to You not less than sixty (60) days before cancellation is effective. This Soroya Hearing Aid Elite Protection Plan can be cancelled by You at any time for any reason by emailing, mailing, or delivering to Us notice of cancellation. If the Soroya Hearing Aid Elite Protection Plan is cancelled: (a) within thirty (30) days of the receipt of the Plan, You shall receive a full refund of the price paid for the Plan provided no service has been performed, or (b) after thirty (30) days, You will receive a refund based on 100% of unearned pro rata premium less any claims that have been paid or less the cost of repairs made by us. If We cancel the Soroya Hearing Aid Elite Protection Plan, the return premium is based upon 100% of the unearned pro rata premium. If We determine in our sole discretion that Your product cannot be repaired or Your product provides for replacement instead of repair, We will replace Your product with a product of like kind and quality that is of comparable performance or reimburse You for replacement of the product with a check, at our discretion, equal to the current market value of the product, as determined by us, not to exceed the original purchase price, including all applicable taxes. This Plan can be cancelled by You at any time for any reason by surrendering or providing written notice to the retailer at the address where You purchased this Plan or to the administrator.

    GEORGIA RESIDENTS: This Soroya Hearing Aid Elite Protection Plan shall be non-cancellable by Us except for fraud, material misrepresentation, or failure to pay consideration due therefore. The cancellation shall be in writing and shall conform to the requirements of Code 33-24-44. You may cancel at any time upon demand and surrender of the Soroya Hearing Aid Elite Protection Plan and We shall refund the excess of the consideration paid for the Plan above the customary short rate for the expired term of the Plan. This Soroya Hearing Aid Elite Protection Plan excludes coverage for incidental and consequential damages and pre-existing conditions only to the extent such damages or conditions are known to You or reasonably should have been known to You.

    ILLINOIS RESIDENTS: You may cancel this Soroya Hearing Aid Elite Protection Plan: (a) within thirty (30) days after its purchase if no service has been provided and a full refund of the Plan price, less a cancellation fee not to exceed the lesser of ten percent (10%) of the Soroya Hearing Aid Elite Protection Plan price or fifty dollars ($50.00); or (b) at any other time and a pro rata refund of the Soroya Hearing Aid Elite Protection Plan price for the unexpired term of the Plan, based on the number of elapsed months less the value of any service received, and the cancellation fee not to exceed the lesser of ten percent (10%) of the Soroya Hearing Aid Elite Protection Plan price or fifty dollars ($50.00).

    MAINE RESIDENTS: With respect to Maine contract holders, Soroya Hearing Aids under this Service Agreement is the Dealer.

    MINNESOTA RESIDENTS: Only 5 days written notice of cancellation will be provided if the reason for cancellation is nonpayment, material misrepresentation, or a substantial breach of duties.

    NEW HAMPSHIRE RESIDENTS: In the event that You do not receive satisfaction under this Agreement, You may contact the New Hampshire insurance department at (516) 340-3333 .

    NEVADA RESIDENTS: If the Soroya Hearing Aid Elite Protection Plan is cancelled, no deduction shall be made from the refund for the cost of any service received. This Soroya Hearing Aid Elite Protection Plan may be cancelled due to unauthorized repair which results in a material change in the nature or extent of the risk, occurring after the first effective date of the current policy, which causes the risk of loss to be substantially and materially increased beyond that contemplated at the time the policy was issued or last renewed.

    NEW MEXICO RESIDENTS: If this Soroya Hearing Aid Elite Protection Plan has been in force for a period of seventy (70) days, We may not cancel before the expiration of the Soroya Hearing Aid Elite Protection Plan term or one (1) year, whichever occurs first, unless: (1) You fail to pay any amount due; (2) You are convicted of a crime which results in an increase in the service required under the Soroya Hearing Aid Elite Protection Plan; (3) You engage in fraud or material misrepresentation in obtaining this Soroya Hearing Aid Elite Protection Plan; (4) You commit any act, omission, or violation of any terms of this Soroya Hearing Aid Elite Protection Plan after the effective date of this Plan which substantially and materially increases the service required under this Plan; or (5) any material change in the nature or extent of the required service or repair occurs after the effective date of this Soroya Hearing Aid Elite Protection Plan and causes the required service or repair to be substantially and materially increased beyond that contemplated at the time You purchased this Plan.

    NORTH CAROLINA RESIDENTS: The purchase of this Soroya Hearing Aid Elite Protection Plan is not required either to purchase or to obtain financing for a home appliance. We may not cancel this Agreement except for nonpayment by You or for violation of any of the terms and conditions of this contract which state that such violation could result in cancellation.

    OKLAHOMA RESIDENTS: If either You or We cancel this Soroya Hearing Aid Elite Protection Plan, the return of the Soroya Hearing Aid Elite Protection Plan price will be based upon one hundred percent (100%) of the unearned pro rata price of the Plan, less the cost of any service received. Soroya Hearing Aids is Soroya Hearing Aids under this Plan.

    SOUTH CAROLINA RESIDENTS: To prevent any further damage, please refer to the owner’s manual or hearing aid manual included with your purchase.

    TENNESSEE RESIDENTS: This Agreement is automatically extended while the product is being repaired plus two business days.

    UTAH RESIDENTS: NOTICE. This Soroya Hearing Aid Elite Protection Plan is subject to limited regulation by the Utah Insurance Department. To file a complaint, contact the Utah Insurance Department Coverage afforded under this Plan is not guaranteed by the Utah Property and Casualty Guaranty Association. This Soroya Hearing Aid Elite Protection Plan may be cancelled due to unauthorized repair which results in a material change in the nature or extent of the risk, occurring after the first effective date of the current policy, which causes the risk of loss to be substantially and materially increased beyond that contemplated at the time the policy was issued or last renewed. Failure to notify within the prescribed time will not invalidate the claim if You can show that notification was not reasonably possible. If We cancel this Soroya Hearing Aid Elite Protection Plan due to fraud or material misrepresentation, You will be notified 30 days prior to the Plan cancellation. If We cancel this Soroya Hearing Aid Elite Protection Plan due to non-payment, You will be notified 10 days prior to the Plan cancellation.

    WASHINGTON RESIDENTS: If We cancel this Agreement We will mail You written notice of the cancellation including reason for and effective date at least twenty one (21) days prior to the effective date of such cancellation.

    WISCONSIN RESIDENTS: THIS Soroya Hearing Aid Elite Protection Plan IS SUBJECT TO LIMITED REGULATION BY THE WISCONSIN OFFICE OF THE COMMISSIONER OF INSURANCE. This Soroya Hearing Aid Elite Protection Plan shall not be cancelled due to unauthorized repair of the covered equipment, unless We are prejudiced by Your failure to obtain such authorization. We will not exclude unauthorized repair of the covered equipment, unless We are prejudiced by Your failure to obtain such authorization. If You cancel this Soroya Hearing Aid Elite Protection Plan, no deduction shall be made from the refund for the cost of any service received.

    WYOMING RESIDENTS: A ten percent (10%) penalty per month shall be added to a refund that is not paid or credited within forty-five (45) days after the return of the Soroya Hearing Aid Elite Protection Plan to us.


    Limitations of liability

    Under no circumstances will Soroya Hearing Aids, its service provider or either's affiliates, employees, officers, directors or agents be liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to), claims for personal damage, goodwill, inconvenience, delay, profits, use of money or use of the Soroya Hearing Aids products or interruption in use.

    Soroya Hearing Aids's and the service provider's entire liability and customer's sole and exclusive remedy for claims related to or arising out of these terms and conditions for any cause and despite the form of action, whether in contract or in tort, statutory or otherwise, including negligence and strict liability, will not exceed the amount of the purchase price paid. This limitation of liability will be effective even if customer has advised Soroya hearing aids or its service provider of the possibility of any such damages.

    These terms and conditions gives the customer specific legal rights. Customer may also have other rights that may vary from state to state or from country to country. Customer is advised to consult applicable state or country laws for a full determination of customer's rights. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of these terms and conditions may not apply to customer.
